회원약관

• (1) 이 약관은 서비스 화면에 온라인으로 공시함으로써 효력이 발생합니다.
• (2) 서비스는 합리적이며 중요한 사유가 있을 때 관계법령에 위배되지 않는 범위 내에서 이 약관을 변경할 수 있으며 변경된 약관은 제1항의 방법으로 적용일자 7일 이전부터 적용일자 전일까지 공지합니다.
• (3) 이 약관에 동의하는 것은 정기적으로 웹사이트를 방문하여 약관의 변경사항을 확인하는 것에 동의함을 의미합니다. 변경된 약관에 대한 정보를 알지 못해 발생하는 이용자의 피해는 UNHCR 한국대표부에서 책임지지 않습니다.
• (4) 회원은 변경된 약관에 동의하지 않을 경우 회원 탈퇴(해지)를 요청할 수 있으며 변경된 약관의 효력 발생일 이후에도 서비스를 계속 사용할 경우 약관의 변경사항에 동의한 것으로 간주합니다.

Article 2 Effect and Modification

• (1) The Agreement shall take effect with on-line notification at the service screen.
• (2) The Agreement may be modified when there is a reasonable and material reason and not in violation of relevant laws and regulations, and the modified Agreement shall be notified from seven days to one day prior to the effective date of the modified Agreement in the method described in above (1).
• (3) Consent to the Agreement shall mean consent on the part of the member to check for modification of the Agreement by regular visits to the website. UNHCR shall not be responsible for any damages incurred to any user due to lack of knowledge about the modification.
• (4) When a member does not consent to the modified Agreement, the member may request withdrawal (cancellation) from the membership and continuous use of the Services after the effective date of the Services shall constitute consent to the modification.

• (1) 회원: UNHCR 한국대표부가 적합하다고 인정하는 일반 개인 후원 회원 및 법인 단체로 이 약관에 동의하고 서비스 회원 가입 양식을 작성하여 이용자 ID와 비밀번호를 부여받은 자.
• (2) ID: 회원의 식별과 서비스 이용을 위하여 회원이 선정하고 UNHCR 한국대표부가 승인하는 문자와 숫자의 조합
• (3) 비밀번호: 회원의 비밀 보호를 위해 회원 자신이 설정한 문자와 숫자의 조합
• (4) 해지: UNHCR 한국대표부 또는 회원이 서비스 개통 후 이용계약을 해약하는 것.

Article 4 Definitions

• (1) “Member” shall mean any individuals or organizations recognized by UNHCR to be an appropriate candidate to become a member who consents to the Agreement and fills out the application form to receive user ID and password.
• (2) “ID” shall mean a combination of characters and numbers selected by an individual member and approved by UNHCR for identification of the member and usage of service.
• (3) “Password” shall mean a combination of characters and numbers selected by a member for privacy protection.
• (4) “Cancellation” shall mean cancellation by UNHCR or by a member of the usage agreement after service initiation.

• (1) 서비스 가입은 이용자의 이용신청에 대한 서비스의 이용 승낙과 이용자의 약관에 대한 동의로 성립됩니다.
• (2) 이 이용약관에 대한 동의는 이용신청 당시 회원가입 페이지의 동의함 버튼을 누름으로써 동의하는 것으로 간주됩니다.

Article 5 Service Subscription

• (1) Subscription is established with approval of service usage at the request of user and with the consent of the user of the terms and conditions of the Agreement.
• (2) Consent to the Agreement is established by clicking the ‘Approve’ button on the subscription webpage while requesting service usage.

• (1) 회원으로 가입하여 본 서비스를 이용하고자 하는 이용 고객은 UNHCR 한국대표부에서 요청하는 정보를 제공하여야 하며 회원이 제공한 정보는 개인정보보호정책에 따라 관리됩니다.
• (2) 회원은 반드시 실명으로만 가입할 수 있으며 UNHCR 한국대표부는 실명확인조치를 할 수 있습니다.
• (3) 타인의 명의를 도용하여 이용신청을 한 회원의 ID는 UNHCR 한국대표부가 임의로 박탈할 수 있으며 이용에 대한 일체의 권리를 주장할 수 없고 관계법령에 따라 처벌을 받을 수 있습니다.
• (4) 제6조의 규정에 의한 이용신청자에 대하여 업무 수행, 또는 기술 상 지장이 없는 경우 원칙적으로 접수 순서에 따라 서비스 이용을 승낙합니다.
• (5) 서비스는 다음 각 호에 해당하는 가입신청에 대하여는 승낙하지 않습니다:
  • ① 회원가입신청서의 내용을 허위로 기재하였을 때
  • ② 사회의 안녕과 질서 혹은 미풍양속을 저해할 목적으로 신청하였을 때
  • ③ 영리를 추구할 목적으로 서비스를 이용하고자 할 때
  • ④ 타인의 명의를 이용하여 신청하였을 때
  • ⑤ 기타 규정한 제반 사항을 위반하며 신청한 경우
• (6) 서비스 이용신청이 다음 각호에 해당할 경우 승낙 제한 사유가 해소될 때 까지 승낙을 유보할 수 있습니다.
  • ① UNHCR 한국대표부의 설비의 여유가 없는 경우
  • ② UNHCR 한국대표부의 기술상 지장이 있는 경우
  • ③ 기타 UNHCR 한국대표부의 귀책사유로 이용승낙이 곤란한 경우

Article 6 Request for Services Usage

• (1) A user who wants to sign up as a member to use the Services should submit the information requested by UNHCR and the provided information shall be managed under the Privacy Policy.
• (2) A membership application can be made only with the user’s real name, and UNHCR may verify the authenticity of the name used.
• (3) ID of a member who requested the service under other persons’ identity can be withdrawn at the discretion of UNHCR, and the member cannot claim any rights of the usage and may be liable under relevant laws and regulations.
• (4) In principle, applicants of the service under Article 6 shall be granted with the usage of the Service in the order of reception of application when there is no issue with business performance or no technical problems.
• (5) Service shall not be granted on any of the following cases:
  • ① Any content of the application is false
  • ② Application is made with the intent to undermine the order and welfare of the society or good public morals
  • ③ Application is to seek personal interest
  • ④ Application is made under an other’s identity
  • ⑤ Application is made in violation of other relevant regulations
• (6) When service application falls under any of the following reasons, the approval may be suspended until the reason for restriction is resolved.
  • ① Insufficient capacity of UNHCR facilities
  • ② Technical glitch with UNHCR
  • ③ Other reasons attributable to UNHCR that may make approval difficult

• (1) UNHCR 한국대표부는 관계 법령이 정하는 바에 따라 이용자 등록정보를 포함한 이용자 개인정보를 보호하기 위해 노력합니다. 단, 서비스 페이지상에 링크된 사이트에서는 UNHCR 한국대표부의 개인정보보호정책이 적용되지 않습니다. 자세한 내용은 UNHCR 한국대표부 공식 홈페이지 하단에 “개인정보처리방침”에서 확인하실 수 있습니다.
• (2) UNHCR 한국대표부는 이용자의 귀책 사유로 인해 노출된 정보에 대해 일체의 책임을 지지 않습니다.

Article 7 Protection and Usage of Private Information

• (1) UNHCR shall exert efforts to protect private information of user including information provided at registration as stipulated by relevant laws and regulations. However, any external website linked with UNHCR website shall not be under UNHCR Policy. More details are available from UNHCR’s Personal Information Processing Policy located on the UNHCR Korea’s Official Website.
• (2) UNHCR shall not be held responsible for any information revealed by reasons attributable to the user.

• (1) UNHCR 한국대표부는 회원이 희망한 서비스 제공 개시일로 부터 특별한 지장이 없는 한 서비스를 이용할 수 있도록 하여야 합니다.
• (2) UNHCR한국대표부는 계속적이고 안정적인 서비스 제공을 위해 설비에 장애가 생기거나 멸실된 때에는 부득이한 사유가 없는 한 지체없이 이를 수리 또는 복구합니다.
• (3) 서비스 이용시간은 시스템 정기점검 등 UNHCR 한국대표부가 필요한 경우 사전 통지한 후 제한 할 수 있습니다.
• (4) UNHCR 한국대표부는 개인정보 보호를 위해 보안시스템을 구축하며 개인정보보호정책을 공시하고 준수합니다.
• (5) UNHCR 한국대표부는 회원으로부터 제기되는 의견이나 불만이 정당하다고 객관적으로 인정될 경우에는 적절한 절차를 거쳐 즉시 처리하여야 합니다. 다만, 즉시 처리가 곤란한 경우는 이용자에게 그 사유와 처리일정을 통보하여야 합니다.

Article 9 Duties of UNHCR

• (1) UNHCR shall allow a member to use services from the date when the member desires to use the service, unless there is any special reason that hinders this.
• (2) UNHCR shall immediately repair or restore any system error or loss, unless there is an unforeseen circumstance in order to provide continuous and stable service.
• (3) Service time can be restricted with prior notice in cases when UNHCR needs such restriction for reasons such as regular system check and maintenance.
• (4) UNHCR shall implement security system for privacy protection and shall notify and honor Privacy Policy.
• (5) When an opinion or a complaint filed by a member is deemed subjectively reasonable, UNHCR should address such opinion or complaint immediately through appropriate procedure. However, when an immediate response cannot be provided, the Office shall notify the member/user of the reasons of delay and the response schedule.

• (1) 이용자는 회원가입 신청 또는 회원정보 변경시 실명으로 모든 사항을 사실에 근거하여 작성하여야 하며, 허위 또는 타인의 정보를 등록할 경우 일체의 권리를 주장할 수 없습니다.
• (2) 회원은 본 약관에서 규정하는 사항과 UNHCR 한국대표부가 정한 제반 규정, 공지사항 및 관계법령을 준수하여야 하며, 기타UNHCR 한국대표부의 업무가 방해가 되는 행위, UNHCR 한국대표부의 명예를 손상시키는 행위를 해서는 안됩니다.
• (3) 회원은UNHCR 한국대표부 및 제3자의 지적 재산권을 침해해서는 안됩니다.
• (4) 회원은UNHCR 한국대표부의 사전 승낙없이 서비스를 이용하여 영업 활동을 할 수 없으며 그 영업활동의 결과에 대해UNHCR 한국대표부는 책임을 지지 않습니다. 또한 회원은 이와 같은 영업활동으로UNHCR 한국대표부가 손해를 입은 경우UNHCR 한국대표부에 대해 손해배상의무를 지며UNHCR 한국대표부는 해당 회원에 대해 서비스 이용제한 및 적법한 절차를 거쳐 손해배상 등을 청구할 수 있습니다.
• (5) 회원은 회원에게 부여된 ID와 비밀번호를 직접 관리해야 합니다. 회원의 관리 소홀로 발생한 문제의 책임은 회원에게 있습니다.
• (6) 회원은 다음 각 호에 해당하는 행위를 해서는 안되며 해당 행위를 하는 경우에UNHCR 한국대표부은 회원의 서비스 이용제한 및 적법 조치를 포함한 제재를 가할 수 있습니다.
  • ① 공공 질서 및 미풍 양속에 반하는 행위
  • ② 범죄적 행위에 관련되는 행위
  • ③ 국익또는 사회적공익을 저해할 목적으로 서비스이용을 계획 또는 실행하는 행위
  • ④ 타인의 ID및 비밀번호를 도용한 행위
  • ⑤ 타인의 명예를 손상시키거나 불이익을 주는 행위
  • ⑥ 서비스에 위해를 가하거나 고의로 방해하는 행위
  • ⑦ UNHCR 한국대표부의 운영진, 직원 또는 관계자를 사칭하는 행위
  • ⑧ UNHCR 한국대표부로 부터 특별한 권리를 부여받지 않고UNHCR 한국대표부의 프로그램을 변경하거나, 서버를 해킹하거나, 웹사이트 또는 게시된 정보의 일부분 또는 전체를 임의로 변경하거나, 서비스를 비정상적으로 사용하는 행위
  • ⑨ 서비스에서 얻은 정보를UNHCR 한국대표부의 사전승락없이 서비스 이용 외의 목적으로 복제하거나, 이를 출판 및 방송 등에 사용하거나, 제3자에게 제공하는 행위
  • ⑩ 본 약관을 포함하여 기타UNHCR 한국대표부가 정한 제반 규정 또는 이용 조건을 위반하는 행위
  • ⑪ 기타 관계법령에 위배되는 행위

Article 10 Duties of Users

• (1) A user shall use his or her real name and provide true and correct information when applying for membership or modifying member information, and shall not claim any rights when the information is that of another person’s or is false.
• (2) A member shall observe the terms and conditions of the Agreement and other regulations, notice of UNHCR and relevant laws and regulation, and shall not engage in any activity that may obstruct the business of UNHCR and/or that may harm the honour of UNHCR.
• (3) A member cannot violate the intellectual property of UNHCR or any third party.
• (4) A member cannot use the services for any business activity without prior approval from UNHCR, and UNHCR shall not be held responsible for such business activity. Also, in case such business activity causes any damages on UNHCR, the member shall be liable to UNHCR for damages, and UNHCR may limit service usage to the member and/or seek damages through legal process.
• (5) A member shall directly manage ID and password given to the member. Any problem caused by lack of care of the member shall be the responsibilities of the member.
• (6) A member cannot engage in any of the followings, and if a member does any of the following activities, UNHCR may impose appropriate penalties including service limitation and other legitimate responses.
  • ① Any act in violation of public order and good morals of the community
  • ② Any act of or related to criminal activity
  • ③ Any planned or actual usage of service with the intent to undermine national or social common good
  • ④ Stealing of another user’s ID and password
  • ⑤ Any act that undermines an other’s honour or causes disadvantage to the other
  • ⑥ Any act that cause damages to the service or any other intentional hindrance
  • ⑦ Impersonation of members of operation, employees or interested persons of UNHCR
  • ⑧ Modification of UNHCR’s program, hacking of service, discretionary modification of part or all of website or information posted on the website, or abnormal usage of service without any special rights granted from UNHCR
  • ⑨ Copying of information acquired from the Service for the purpose other than service usage, its publication, broadcasting, or provision to a third party without any prior consent from UNHCR
  • ⑩ Any act in violation of the Agreement or other regulations specified by UNHCR.
  • ⑪ Any act in violation of the relevant laws and regulations

• (1) 서비스 이용은UNHCR 한국대표부의 업무상 또는 기술상 특별한 지장이 없는 한 연중무휴, 1일 24시간 운영을 원칙으로합니다. 단, UNHCR 한국대표부는 시스템 정기점검, 증설 및 교체를 위해UNHCR 한국대표부가 정한 날이나 시간에 서비스를 일시 중단할 수 있으며 예정되어 있는 작업으로 인한 서비스 일시중단은UNHCR 한국대표부 홈페이지를 통해 사전에 공지합니다
• (2) UNHCR 한국대표부는 긴급한 시스템 점검, 증설 및 교체 등 부득이한 사유로 인하여 예고없이 일시적으로 서비스를 중단할 수 있으며 새로운 서비스로의 교체 등UNHCR 한국대표부가 적절하다고 판단하는 사유에 의하여 현재 제공되는 서비스를 완전히 중단할 수 있습니다.
• (3) UNHCR 한국대표부는 국가비상사태, 정전, 서비스 설비의 장애 또는 서비스이용의 폭주 등으로 정상적인 서비스 제공이 불가능할 경우 서비스의 전부 또는 일부를 제한하거나 중지할 수 있습니다. 다만 이 경우 그 사유 및 기간을 회원에게 사전 또는 사후에 공지합니다.
• (4) UNHCR 한국대표부는UNHCR 한국대표부가 통제할 수 없는 사유에따른 서비스 중단의 경우 사전통지가 불가능하며 타인의 고의, 과실로 인한 시스템 중단의 경우에는 통지하지 않습니다.
• (5) UNHCR 한국대표부는 서비스를 특정범위로 분할하여 각 범위별로 이용가능시간을 별도로 지정할 수 있습니다. 다만 이 경우 그 내용을 공지합니다.

Article 11 Service Usage

• (1) Service usage is for 365 days a year, 24 hours a day when there are no business or technical concerns with UNHCR precluding such use. However, UNHCR may suspend the service on the day or hours designated by the Office for system regular checkup, addition and/or replacement, and such temporary suspension of service due to planned activity shall be notified through UNHCR webpage.
• (2) UNHCR may temporarily suspend the service without any prior notice for such unforeseen reasons as emergency system checkup, addition and/or modification, and may completely suspend the current service for reasons deemed reasonable by UNHCR such as replacement by a new service.
• (3) When service cannot be provided normally due to national emergency, blackout, service facility failure or service congestion, UNHCR may restrict or suspend part or all of the services. However, the reasons and the period of restriction or suspension shall be notified prior to or after such interruption.
• (4) In case of service suspension due to reasons that cannot be controlled by UNHCR, the Office cannot make prior notice, and shall not provide notice in case of service suspension due to intentional or accidental act of others.
• (5) UNHCR may divide the services into different sections and designate the service hours by section. In such case the different service hours shall be notified to the Members.

• (1) 서비스는 회원으로 등록한 모든 사람들이 무료로 사용할 수 있습니다.
• (2) 서비스가 서비스를 유료화할 경우 유료화 시기, 정책, 비용에 대하여 유료화 실시 이전에 서비스에 공시하여야 합니다.

Article 12 Service Fee

• (1) Service is provided for free to all registered members.
• (2) If the service is changed to charged service, the timing, policy and fee should be notified as prescribed above.

• (1) 회원이 서비스 탈퇴를 원하며 회원 본인이 직접 전자메일을 통해 운영자(withyou@unhcr.or.kr) 에게 해지 신청을 요청합니다.
• (2) 탈퇴 신청시 본인임을 알 수 있는 이름, 생년월일, ID, 전화번호, 해지사유를 알려주면 가입기록과 일치여부를 확인한 후 가입을 해지합니다.
• (3) 탈퇴 여부는 기존 ID와 비밀번호로 로그인 되지 않는 것으로 확인 가능합니다.

Article 13 Service Cancellation

• (1) If a member requests cancellation of the service, the member shall request cancellation to the administrator by email (withyou@unhcr.or.kr).
• (2) When requesting cancellation the member must include name, date of birth, ID, phone number for identification and the reasons of cancellation, the information shall be matched with application information and when matched the request shall be processed.
• (3) Cancellation can be verified with inability to log in with existing ID and password.

• (1) UNHCR 한국대표부는 회원이 서비스이용에 있어 본 약관 11조의 내용의 위반하거나 다음 각 호에 해당하는 경우 서비스 이용을 제한할 수 있습니다.
  • ① 미풍양속을 저해하는 비속한 아이디 및 별명사용
  • ② 타 이용자에게 심한 모욕을 주거나 서비스 이용을 방해한 경우
  • ③ 기타 정상적인 서비스 운영에 방해가 될 경우
  • ④ 정보통신 윤리위원회 등 관련 공공기관의 시정 요구가 있는 경우
• (2) 상기 이용 제한 규정에 따라 서비스를 이용하는 회원에게 서비스 이용에 대하여 별도 공지 없이 서비스 이용의 일시 정지, 초기화, 이용계약 해지 등을 불량이용자 처리규정에 따라 취할 수 있습니다.

Article 14 Restriction of Service

• (1) UNHCR may restrict service usage for a member in violation of any clause of Article 11 or any of the following reasons.
  • ① When vulgar ID and/or nickname is used in violation of good morals of the society
  • ② When a member insults other user or hindered usage of service
  • ③ Any other hindrance of ordinary service operation
  • ④ When relevant public agency including the Korea Communications Standards Commission requests such correction
• (2) For any member that uses the service in line with any of the above restriction clauses, service usage can be treated in line with the terms as such for delinquent user including temporary suspension, initialization, and/or cancellation of Agreement without any separate notice.

• (1) UNHCR 한국대표부는 천재지변, 전쟁 및 기타 이에 준하는 불가항력으로 인하여 서비스를 제공할 수 없는 경우에는 서비스 제공에 대한 책임이 면제됩니다.
• (2) UNHCR 한국대표부는 기간통신 사업자가 전기통신 서비스를 중지하거나 정상적으로 제공하지 아니하여 손해가 발생한 경우 책임이 면제됩니다.
• (3) UNHCR 한국대표부는 서비스용 설비의 보수, 교체, 정기점검, 공사 등 부득이한 사유로 발생한 손해에 대한 책임이 면제됩니다.
• (4) UNHCR 한국대표부는 회원의 귀책사유로 인한 서비스 이용의 장애 또는 손해에 대하여 책임을 지지 않습니다.
• (5) UNHCR 한국대표부는 이용자의 컴퓨터 오류에 의해 손해가 발생한 경우, 또는 회원이 신상정보 및 전자우편 주소를 부실하게 기재하여 손해가 발생한 경우 책임을 지지 않습니다.
• (6) UNHCR 한국대표부는 회원이 서비스를 이용하여 기대하는 수익을 얻지 못하거나 상실한 것에 대하여 책임을 지지 않습니다.
• (7) UNHCR 한국대표부는 회원이 서비스를 이용하면서 얻은 자료로 인한 손해에 대하여 책임을 지지 않습니다. 또한UNHCR 한국대표부는 회원이 서비스를 이용하며 타 회원으로 인해 입게 되는 정신적 피해에 대하여 보상할 책임을 지지 않습니다.
• (8) UNHCR 한국대표부는 회원이 서비스에 게재한 각종 정보, 자료, 사실의 신뢰도, 정확성 등 내용에 대하여 책임을 지지 않습니다.
• (9) UNHCR 한국대표부는 이용자 상호간 및 이용자와 제3자 상호 간에 서비스를 매개로 발생한 분쟁에 대해 개입할 의무가 없으며, 이로 인한 손해를 배상할 책임도 없습니다.
• (10) UNHCR 한국대표부는 회원에게 무료로 제공하는 서비스의 이용과 관련해서는 어떠한 손해도 책임을 지지 않습니다.

Article 17 Indemnity

• (1) UNHCR shall be exempt from the duty to provide service when natural disaster, war, or other force majeure prevents service provision.
• (2) UNHCR shall be exempt from damages from loss incurred when the telecom service provider suspended the telecom service or failed to provide telecom service in the normal manner.
• (3) UNHCR shall be exempt from damages from loss incurred due to unavoidable reasons including repair, replacement, regular checkup, or other construction of facilities for services.
• (4) UNHCR shall not be responsible for loss or hindrance to service of reasons attributable to members.
• (5) UNHCR shall not be responsible for any loss incurred from error related to user’s computer, or from incorrect personal information and/or email address provided by a member.
• (6) UNHCR shall not be responsible when a member fails to earn expected profit or loss profit from using the service.
• (7) UNHCR shall not be responsible for any loss resulting from the information gathered by a member while using the service. Also, UNHCR shall not be responsible for any psychological damages to a member incurred by other member in the course of service usage.
• (8) UNHCR shall not be responsible for credibility, truthfulness and other contents guarantee of information, data, and/or facts posted by a member to the services.
• (9) UNHCR shall not be responsible to intervene in any dispute occurring between users or between a user and a third party over the services, nor to pay any damages from the dispute.
• (10) UNHCR shall not be responsible for any damages from usage of service that is provided for free to members.

• (1) 본 약관에 대한 분쟁 혹은 이의가 발생하거나 본 약관을 위배, 해지, 무효화 할 경우 쌍방은 우호적으로 이를 해결하기 위해 최선의 노력을 기울여야합니다. 쌍방이 협의를 통해 우호적으로 해결을 원하는 경우 이러한 협의는 유엔국제상거래법위원회(UNCITRAL)의 조정 규칙 혹은 쌍방이 서면 동의한 여타절차에 따를 수 있습니다.
• (2) 본 약관과 관련하여 이의가 발생하여 이의가 제기된 시점으로부터 60일 이내 우호적인 해결이 되지 않을 경우 유엔국제상거래법위원회(UNCITRAL)의 중재규칙에 의거하여 중재를 제의할 수 있습니다. 중재 법정의 결정은 국제상거래법의 일반적인 원칙을 기준으로 합니다. 중재 법정은 유엔국제상거래법위원회 중재에 관한 규정 제26조 (“임시적 보호조치”)와 제32조 (“보상의 형태와 효과”)에 따른 중재 법정의 권한에 따라 적절하게 유형∙무형을 불문한 상품, 재산, 또는 본 약관 하에 제공된 모든 기밀정보의 반납 또는 파기를 명령하거나, 약관의 종료 및 유형∙무형을 불문한 상품, 서비스, 재산, 또는 본 약관 하에 제공된 모든 기밀정보와 관련하여 보호조치를 취하는 것에 대한 명령권을 부여 받습니다. 중재 법정은 징벌적 손해배상을 판정할 권한이 없습니다. 또한 본 약관 하에 달리 명시되지 않는 한, 중재 법정은 당시에 우세한 런던 은행간 거래 금리(LIBOR: the London Inter-Bank Offered Rate)를 초과하는 이자의 지급을 판정할 권한을 가지지 아니하며, 상기의 이자는 단리여야 합니다. 각 당사자는 분쟁, 논란, 청구 등의 최종 판결로써 이러한 중재의 결과로 제시된 중재보상을 반드시 따라야 합니다.

Article 18 Disputes and Arbitration

• (1) The Parties shall use their best efforts to settle amicably any dispute, controversy or claim arising out of this Agreement or the breach, termination or invalidity thereof. Where the parties wish to seek such an amicable settlement through conciliation, the conciliation shall take place in accordance with the Conciliation Rules then obtaining of the United Nations Commission on International Trade Law (UNCITRAL), or according to such other procedure as may be agreed between the parties in writing.
• (2) Any dispute, controversy or claim between the Parties arising out of this Agreement or the breach, termination or invalidity thereof, unless settled amicably under the preceding paragraph of this Article, within sixty (60) days after receipt by one Party of the other Party's request for such amicable settlement, shall be referred by either Party to arbitration in accordance with the UNCITRAL Arbitration Rules then obtaining. The decisions of the arbitral tribunal shall be based on general principles of international commercial law. The arbitral tribunal shall be empowered to order the return or destruction of goods or any property, whether tangible or intangible, or of any confidential information provided under this Agreement, order the termination of this Agreement, or order that any other protective measures be taken with respect to the goods, services or any other property, whether tangible or intangible, or of any confidential information provided under this Agreement, as appropriate, all in accordance with the authority of the arbitral tribunal pursuant to Article 26 (“Interim Measures of Protection”) and Article 32 (“Form and Effect of the Award”) of the UNCITRAL Arbitration Rules. The arbitral tribunal shall have no authority to award punitive damages. In addition, unless otherwise expressly provided in this Agreement, the arbitral tribunal shall have no authority to award interest in excess of the London Inter-Bank Offered Rate (“LIBOR”) then prevailing, and any such interest shall be simple interest only. The parties shall be bound by any arbitration award rendered as a result of such arbitration as the final adjudication of any such dispute, controversy, or claim.
